504s and IEPs: Two Paths to Support
Colorado students with disabilities may qualify for support under two main federal laws:
1. Section 504 of the Rehabilitation Act (1973) Section 504 prohibits discrimination on the basis of disability in programs receiving federal funding—including public schools. A 504 Plan provides accommodations (such as extended time or preferential seating) to help students access learning, even if they don’t need special education services.
2. Individuals with Disabilities Education Act (IDEA) IDEA guarantees a free appropriate public education (FAPE) for every child with a disability. Through the Individualized Education Program (IEP) process, eligible students receive not only accommodations, but also direct instruction, specialized services, and measurable goals for improvement.
Key Differences:
- 504 Plans: May not require formal testing; focus on accommodations; updated yearly; parent involvement encouraged but not legally required.
- IEPs: Require formal evaluation for eligibility; provide direct instruction and goals; updated yearly; parent involvement is legally mandated; re-evaluation every three years.
The Importance of Eligibility: Colorado’s Exceptional Children’s Educational Act (ECEA)
Eligibility for special education is determined by a team using Colorado’s ECEA guidelines. Categories include:
- Autism Spectrum Disorder
- Deaf-Blindness
- Developmental Delay
- Hearing Impairment (Including Deafness)
- Intellectual Disability
- Multiple Disabilities
- Orthopedic Impairment
- Other Health Impairment (e.g., ADHD, diabetes)
- Serious Emotional Disability
- Specific Learning Disability
- Speech or Language Impairment
- Traumatic Brain Injury
- Visual Impairment (Including Blindness)
Note: A medical diagnosis does not automatically qualify a child for special education. Eligibility requires evidence that the disability prevents the child from receiving reasonable educational benefit from general education, and is not primarily due to lack of instruction, language proficiency, or environmental/economic factors.
Independent Educational Evaluations (IEE): Your Rights and Our Expertise
Sometimes, parents may disagree with the school district’s evaluation. In these cases, you have the right to request an IEE at public expense. According to the Colorado Department of Education’s “A Guide to Parent Rights in Special Education” and Disability Law Colorado’s IEE Q&A:
- The IEE must be completed by an independent evaluator not employed by the district.
- The IEP team is required to consider the IEE results when developing your child’s educational program.
- You do not have to explain why you disagree with the district’s evaluation, unless you wish to.
- While you can request an IEE verbally, it’s best practice to submit your request in writing for documentation.
